Environmental attorneys will handle law suits that involve the violation of environmental policy. This can include pollution of land, water, or air, or the failure to contain hazardous substances. Pollution will result in damage to peoples' physical health, as well as damage to the ecosystem. These attorneys will also work for organizations that create and promote environmental policy. Attorneys that represent their clients in environmental lawsuits will charge in a variety of ways. Cost will vary greatly depending on the law firm and the type of case in question. Cases that involve a great amount of research, paperwork, and hours spent in litigation, will be considerably more expensive than other cases. Attorney’s fees may also be based on the amount of experience and expertise that this professional has in a certain area.
It is very important that
attorney’s fees be negotiated upfront, before the attorney begins
working on the case. It is always beneficial for clients to "shop
around" when hiring an attorney to be sure they are getting the most
qualified person for the most reasonable price. Clients should ask
attorneys how much they expect the fees to be in total. Sometimes, a
lawyer may quote a retainer fee that is not the total cost of the case.
Depending on the practices of the specific attorney, fees may be based
on an hourly rate, or a flat fee. Sometimes, attorneys feel in
environmental cases may be based on contingent fees.
Sometimes,
if the plaintiff prevails in the environmental suit, the defendant will
also be required to pay the plaintiff's attorneys fees. Environmental
cases can also be handled by attorneys pro bono (for free). In an effort
to promote environmental legislation, the government has added
attorney’s fees provisions into the statutes. Many times, non-profit
organizations will handle these cases without collecting fees. This is
done to encourage citizens to engage in civil suits without being
financially ruined by attorney’s fees. When citizens are harmed by
environmental pollution or contamination, they are entitled to be
compensated. Not only will this reimburse a person for their injuries,
but it will punish the defendant for engaging in this harmful activity.
